This Acceptable Use Policy (“Policy”) governs your use of the Profitility mobile application and related services (collectively, the “Service”) operated by Grindstone Holdings LLC (“Company,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to comply with this Policy.
1. Purpose of the Service
The Service is designed to assist users in tracking and analyzing financial and operational data for personal use.
2. Prohibited Uses
You shall not use the Service in any manner that violates this Policy or applicable law.
2.1 Violations of Law
You shall not use the Service to:
• Violate applicable laws or regulations
• Facilitate fraud or misrepresentation
• Engage in unlawful financial reporting
2.2 Fraudulent Activity
You shall not:
• Submit false or misleading financial data
• Generate fraudulent documentation
• Misrepresent financial information
2.3 Platform Misuse
You shall not:
• Misrepresent affiliation with any third-party platform
• Submit manipulated or misleading data
• Use the Service for deceptive purposes
2.4 Technical Exploitation
You shall not:
• Reverse engineer, decompile, or disassemble the Service
• Attempt to extract source code or algorithms
• Circumvent access controls or security measures
2.5 Data Scraping & Automation
You shall not:
• Use bots or automated tools to access the Service
• Extract or replicate data at scale
• Redistribute Service outputs without authorization
2.6 Commercial Misuse
You shall not:
• Resell or sublicense access to the Service
• Use the Service for unauthorized commercial purposes
2.7 Account Misuse
You shall not:
• Share account credentials
• Impersonate another individual
• Use false or misleading account information
You are responsible for all activity conducted under your account.
3. Data Integrity & Accuracy
All OCR-extracted data and analytics outputs are informational estimates only and may contain errors.
4. Security Violations
You shall not:
• Attempt unauthorized system access
• Disrupt system functionality
• Introduce malicious code
5. Enforcement / Termination
The Company may suspend or terminate access for violation of these terms, including fraud, abuse, or unlawful activity.
6. Data Ownership
Users retain ownership of their data. The Company is granted a limited license to store, process, and analyze data solely to operate the Service.
7. Third-Party Services
The Service relies on third-party providers for infrastructure, analytics, OCR processing, and payment processing.
We are not responsible for service interruptions or failures caused by third parties.
8. OCR & Data Accuracy
All OCR-extracted data and analytics outputs are informational estimates only and may contain errors.
9. Tax & Financial Disclaimer
The Service provides informational and organizational tools only and does not constitute tax, legal, accounting, or financial advice.
10. Platform Non-Affiliation
Profitility is not affiliated with, endorsed by, or sponsored by any third-party delivery or gig platform.
11. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability.
12. Limitation of Liability
To the fullest extent permitted by law, Grindstone Holdings LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wages, or data inaccuracies.
This includes, without limitation:
• Tax penalties or audit outcomes
• OCR errors or data extraction inaccuracies
• Financial or business decisions made using the Service
Total liability shall not exceed:
• The amount paid by the user in the twelve (12) months preceding the claim, or
• Fifty dollars ($50) if no payment has been made
13. Indemnification
Users agree to indemnify and hold harmless Grindstone Holdings LLC from claims arising from:
• Misuse of the Service
• Violation of this Policy
• Fraudulent or unlawful activity
• User-provided data or financial decisions
14. Arbitration
Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.
15. Modifications
The Company may modify these terms at any time. Continued use of the Service constitutes acceptance of the revised terms.
Material changes may be communicated through:
• In-app notification
• Email (if available)
• Updated Effective Date
16. Severability
If any provision of this Policy is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
This Policy constitutes the entire agreement regarding acceptable use of the Service.
18. Governing Law
This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
