1. PURPOSE

This Acceptable Use Policy governs conduct when using Profitility. Users must use the Service lawfully, honestly, securely, and consistently with the Terms of Service and EULA.

2. PROHIBITED CONDUCT

• Fraud, deception, unlawful activity, or intentional submission of materially false information.

• Impersonation, credential theft, unauthorized account access, or insecure credential sharing.

• Bypassing authentication, subscriptions, entitlements, rate limits, security controls, or technical restrictions.

• Introducing malware or attempting to disrupt, overload, probe, or damage the Service.

• Unauthorized scraping, bots, bulk extraction, automated replication, or harvesting of Service data.

• Reverse engineering, copying, reselling, sublicensing, or commercially exploiting the Service except where permitted by law or authorized.

• Infringing intellectual-property, privacy, publicity, contractual, or other rights of another person.

3. USER DATA AND CONTENT

You may submit only content you are authorized to use. You are responsible for its accuracy, legality, and appropriateness and must not use OCR, upload, AI, or other features to process content unlawfully.

4. AI, OCR, AND AUTOMATION

Do not use automated or AI-assisted features to facilitate fraud, unlawful conduct, deceptive records, unauthorized surveillance, or circumvention of third-party rules. OCR-extracted data and automated outputs may contain errors and must be verified by the user.

5. THIRD-PARTY PLATFORMS

Profitility is not affiliated with, endorsed by, or sponsored by any third-party delivery or gig platform. Users remain responsible for complying with third-party platform rules.

6. SECURITY REPORTING

Do not test or exploit suspected vulnerabilities without authorization. Report suspected security issues or misuse to support@profitility.app.

7. ENFORCEMENT AND TERMINATION

The Company may suspend or terminate access for violation of applicable terms, including fraud, abuse, unlawful activity, or conduct that threatens the security or integrity of the Service.

8. ARBITRATION

Any dispute arising out of or relating to this policy shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.

9. MODIFICATIONS AND VERSIONING

The Company may modify this policy from time to time. Material changes may be communicated through an updated Effective Date, in-app notice, email when available, or affirmative acceptance where required. Profitility may use the Version: field to administer applicable re-acceptance requirements.

10. GOVERNING LAW

This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
