This Intellectual Property & Copyright Policy (“Policy”) explains the ownership, protection, and permitted use of intellectual property within the Profitility application (“App” or “Service”). By using Profitility, you agree to comply with this Policy.

 

1. Ownership of Intellectual Property

  • All software, source code, algorithms, databases, analytics models, designs, user interfaces, graphics, logos, and branding within Profitility are exclusive property of Grindstone Holdings LLC.

  • This includes both the App and all related content or documentation.

  • No intellectual property rights are transferred to users unless explicitly stated in a license agreement.

 

2. License to Users

  • Grindstone Holdings LLC grants users a limited, non-exclusive, non-transferable, revocable license to:

    • Download, install, and use the App on their own devices

    • Access and utilize features in accordance with the End User License Agreement (EULA) and Terms of Service

  • This license is strictly for personal, non-commercial use by individual independent contractors.

 

3. Prohibited Uses

Users may not:

A. Reproduction & Distribution

  • Copy, modify, reproduce, or distribute the App or any part of its content

  • Share or resell access to the Service or any outputs

B. Reverse Engineering & Derivative Works

  • Reverse engineer, decompile, disassemble, or attempt to extract source code

  • Create derivative works based on the App, algorithms, or analytics models

C. Unauthorized Commercial Use

  • Use outputs for commercial purposes without express permission

  • Provide Profitility as a service bureau or in bulk financial reporting services

D. Intellectual Property Infringement

  • Upload content that violates third-party IP rights

  • Use the Service to facilitate piracy or copyright infringement

Consequences: Violations may result in account suspension, termination, or legal action.

 

4. Copyright Infringement Notices (DMCA)

  • Grindstone Holdings LLC respects copyright laws and complies with the Digital Millennium Copyright Act (DMCA).

  • If you believe your copyrighted work has been infringed, submit a written notice including:

    1. Identification of the copyrighted work

    2. Location of the infringing material within the App

    3. Your contact information

    4. A statement of good faith belief that use is unauthorized

    5. A statement under penalty of perjury that the information is accurate

    6. Your physical or electronic signature

  • We will investigate and may remove or disable access to infringing content promptly.

 

5. User-Generated Content

  • Users retain ownership of any content they upload or provide to the App, such as data entries, screenshots for OCR, or notes.

  • By uploading or submitting content, users grant Grindstone Holdings LLC a limited, non-exclusive, worldwide, royalty-free license to:

    • Store, process, analyze, and display the content for App functionality

    • Use the content for internal development or analytics improvement

  • This license does not grant Grindstone Holdings LLC ownership of your content.

 

6. Reporting IP Violations

  • If you become aware of misuse of our intellectual property or copyright infringement:

    • Contact: support@profitility.app

    • Provide a clear description of the alleged violation

    • Include any evidence or documentation supporting your claim

 

7. Policy Modifications

  • This Policy may be updated to reflect changes in law, technology, or business practices.

  • Notice will be provided via:

    • App notification

    • Email communication

    • Updated policy date

  • Continued use of the Service constitutes acceptance of the revised Policy.

 

8. Relationship to Other Agreements

  • This Policy should be read in conjunction with:

    • End User License Agreement (EULA)

    • Terms of Service

    • Acceptable Use Policy

    • Privacy Policy

  • Conflict: In the event of conflict, the EULA and Terms of Service shall take precedence.
