PROFITILITY – SUBSCRIPTION TERMS

1. ACCESS LEVELS
Profitility may offer Basic or free access and Professional access. Professional access may arise from a paid subscription, Early Adopter access, trial, promotion, lifetime access, administrative grant, or another Company-authorized entitlement. Professional access does not necessarily mean a paid subscription.
2. PAID SUBSCRIPTIONS
Paid subscriptions are offered through supported storefronts. The price, billing period, product, renewal terms, and offer details displayed by Apple App Store or Google Play at purchase govern the transaction. Available plans and prices may change.
3. AUTOMATIC RENEWAL
A paid subscription automatically renews according to the terms presented by the applicable storefront unless canceled before renewal. Manage or cancel it through the applicable Apple App Store or Google Play account settings. Cancellation prevents future renewal charges but ordinarily does not refund prior charges or terminate access already purchased for the current billing period.
4. FREE TRIALS AND INTRODUCTORY OFFERS
When a free trial or introductory offer is available, storefront eligibility, duration, price after the offer, and renewal terms presented at purchase control. Unless canceled before the offer ends as required by the storefront, the subscription may automatically renew as a paid subscription. Eligibility is not guaranteed to every user.
5. EARLY ADOPTER ACCESS
Early Adopter access is complimentary Professional access and is not a paid subscription or free trial. Eligible Early Adopters receive complimentary Professional access during the Early Adopter period and for two (2) additional calendar months after the Company’s paid launch date. Early Adopter status alone never creates a charge and never automatically converts to a paid subscription.
After complimentary Early Adopter access ends, continued Professional access requires a separately initiated qualifying subscription or another valid Professional entitlement; otherwise the account may continue with the then-available free or Basic offering. Any storefront trial or introductory offer is a separate affirmative transaction and remains subject to storefront eligibility.
6. PAYMENT PROCESSING
Payments for supported mobile subscriptions are processed through Apple App Store or Google Play. The Company does not directly collect or store your full payment-card credentials for those platform transactions. Subscription-management infrastructure may process entitlement and transaction metadata needed to provide access.
7. REFUNDS AND BILLING DISPUTES
Except where required by law, subscription charges are final. Refund eligibility and billing disputes for Apple App Store or Google Play purchases are governed by the applicable platform provider’s policies.
8. ACCOUNT DELETION
Deleting a Profitility account does not itself cancel an Apple or Google subscription. You must separately manage or cancel the subscription through the applicable storefront.
9. ENFORCEMENT AND TERMINATION
The Company may suspend or terminate access for violation of applicable terms, including fraud, abuse, unlawful activity, or conduct that threatens the security or integrity of the Service.
10. ARBITRATION
Any dispute arising out of or relating to this policy shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.
11. MODIFICATIONS AND VERSIONING
The Company may modify this policy from time to time. Material changes may be communicated through an updated Effective Date, in-app notice, email when available, or affirmative acceptance where required. Profitility may use the Version: field to administer applicable re-acceptance requirements.
12. GOVERNING LAW
This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
