This Platform Non-Affiliation Statement (“Statement”) applies to the use of the Profitility application and related services (“App,” “Service”) operated by Grindstone Holdings LLC (“Company,” “we,” “our,” or “us”).
By using the Service, you acknowledge and agree to the terms of this Statement.
1. Non-Affiliation Disclaimer
Profitility is an independent third-party application designed to assist independent contractor delivery drivers with tracking earnings, expenses, mileage, and profitability.
Profitility is not affiliated with, endorsed by, sponsored by, or connected to any delivery platform or third-party service (“Platform”), including but not limited to:
- Uber
- DoorDash
- Instacart
- Spark Driver
- Grubhub
- Postmates
Any references to Platforms within the App are provided solely for informational, analytical, or personal recordkeeping purposes.
2. No Platform Endorsement
Profitility:
- Does not represent or act on behalf of any Platform.
- Does not have access to proprietary Platform systems beyond data voluntarily provided by users.
- Does not integrate directly with Platform accounts unless explicitly stated in writing.
- Does not guarantee compatibility, accuracy, or continued functionality with any Platform.
- Is not responsible for Platform policies, rule changes, compensation structures, or operational decisions.
Users are solely responsible for reviewing and complying with the terms and conditions of any Platform with which they contract.
3. Data Usage & Platform References
- Platform names, logos, and identifiers may be referenced solely for user identification and tracking purposes.
- Profitility processes only data entered, uploaded, or otherwise provided by the user (including manual entry, screenshots, or OCR processing).
- Profitility does not access, scrape, extract, or log into Platform accounts.
- Users are responsible for ensuring their use of the Service does not violate any agreement with a Platform.
4. Limitation of Liability
To the maximum extent permitted by law, Profitility and Grindstone Holdings LLC are not liable for:
- Platform account suspensions, restrictions, deactivations, or terminations.
- Discrepancies between Profitility analytics and Platform-reported earnings.
- User conduct that violates Platform terms.
- Errors resulting from manual data entry, screenshot uploads, OCR processing, or incomplete information.
Nothing in this Statement expands liability beyond the limitations set forth in the Profitility Terms of Service.
5. Enforcement
- Users who attempt to falsely imply affiliation between Profitility and any Platform may have their accounts suspended or terminated.
- Users who attempt to use the Service to circumvent Platform rules or restrictions may have their access revoked.
- Users are responsible for ensuring the accuracy of all data entered into the Service.
6. Modifications
We may update this Platform Non-Affiliation Statement at any time.
Material changes may be communicated through:
- In-app notification
- Email (if provided)
- Updated Effective Date
Continued use of the Service after changes become effective constitutes acceptance of the revised Statement.
