1. NO AFFILIATION

Profitility is an independent product of Grindstone Holdings LLC. Profitility is not affiliated with, endorsed by, sponsored by, owned by, or operated by any third-party delivery, rideshare, shopping, courier, or gig-work platform unless expressly stated otherwise.

2. THIRD-PARTY NAMES AND MARKS

Third-party company names, platform names, trademarks, service marks, logos, or other identifiers may be referenced solely for identification, categorization, recordkeeping, compatibility explanation, or user-selected business organization. All third-party marks remain the property of their respective owners.

3. EXAMPLES

Third-party platforms referenced by users or the Service may include services such as Uber, DoorDash, Instacart, Spark Driver, Grubhub, Postmates, Shipt, and other gig or delivery platforms. Inclusion or omission of a platform name does not imply a relationship with Profitility.

4. NO ENDORSEMENT OR PARTNERSHIP

A reference to a third-party platform does not imply endorsement, sponsorship, partnership, agency, employment, authorization, or contractual relationship between that platform and Grindstone Holdings LLC.

5. USER RESPONSIBILITY

Users remain responsible for complying with the terms, policies, reporting requirements, and other obligations of any third-party platforms they use. Profitility does not modify those obligations.

6. THIRD-PARTY DATA AND AVAILABILITY

Profitility does not guarantee the accuracy, availability, policies, earnings information, or continued operation of any third-party platform. Third-party changes may affect how users categorize or understand information within Profitility.

7. REPORTING CONCERNS

Questions concerning references to a third-party name or mark may be directed to support@profitility.app.

8. ENFORCEMENT AND TERMINATION

The Company may suspend or terminate access for violation of applicable terms, including fraud, abuse, unlawful activity, or conduct that threatens the security or integrity of the Service.

9. ARBITRATION

Any dispute arising out of or relating to this policy shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.

10. MODIFICATIONS AND VERSIONING

The Company may modify this policy from time to time. Material changes may be communicated through an updated Effective Date, in-app notice, email when available, or affirmative acceptance where required. Profitility may use the Version: field to administer applicable re-acceptance requirements.

11. GOVERNING LAW

This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
