This Privacy Policy (“Policy”) explains how Grindstone Holdings LLC (“Company,” “we,” “us,” or “our”) collects, uses, processes, stores, retains, and protects information when you access or use the Profitility mobile application and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you acknowledge this Policy. Where applicable law or the Service requires affirmative acceptance, Profitility may request and record that acceptance.

The Service is intended only for individuals who are at least eighteen (18) years of age.

1. INFORMATION WE COLLECT

1.1 Account and Authentication Information

We may collect or process account information such as:

• Email address.

• Account identifier and account creation date.

• Authentication and session information necessary to establish and maintain account access.

• Subscription, entitlement, access-level, and account-status information.

• Records of acceptance of applicable agreements, policies, and disclosures, including version, date and time, and language presented when recorded.

Authentication may be provided through third-party service infrastructure. We do not need your plaintext password in order to operate Profitility.

1.2 User-Provided Financial and Operational Data

You may provide financial, operational, and business information, including:

• Earnings, tips, and related income records.

• Expenses and expense categories.

• Mileage and related trip or work records.

• Order, trip, shift, or platform-related details you choose to record.

• Profitability, tax-planning, and other business records or inputs.

1.3 Uploaded Content, OCR, and Extracted Data

The Service may allow you to submit images, receipts, screenshots, documents, addresses, or other content for OCR, extraction, categorization, or related processing. Submitted content and extracted text or structured data may be transmitted to and processed by Service infrastructure or third-party processing providers as necessary to perform the requested function.

Extracted or derived information may be stored as part of your Profitility records. Specific retention of submitted source files or images depends on the applicable feature and is subject to the Service’s current implementation and retention practices.

1.4 AI and Automated Processing Data

When you use AI-assisted or automated features, information relevant to your request may be processed to generate insights, summaries, briefings, recommendations, forecasts, classifications, or similar outputs. This may include user-provided business information, extracted data, and contextual information necessary to perform the requested feature.

1.5 Device, Usage, and Diagnostic Information

We may collect or process limited technical and usage information such as:

• Device type and operating system.

• Application version.

• Session and feature activity.

• Error, diagnostic, and performance information.

• Technical identifiers or security information reasonably necessary to operate, protect, troubleshoot, and improve the Service.

1.6 Location and Mileage Information

Profitility may process mileage, trip, route, address, or location-related information that you enter, import, submit, or otherwise provide through available features. This Policy does not state that Profitility continuously tracks precise device location unless a feature that does so is implemented and separately disclosed.

2. HOW WE USE INFORMATION

We use information as reasonably necessary to:

• Provide, operate, maintain, and support the Service.

• Authenticate users and maintain account sessions.

• Process and organize financial and operational information.

• Perform OCR, extraction, calculations, analytics, AI-assisted processing, and requested Service functions.

• Generate reports, summaries, insights, forecasts, and performance tools.

• Determine and administer Basic, Professional, Early Adopter, trial, promotional, lifetime, subscription, or other authorized access.

• Maintain security, prevent fraud and abuse, troubleshoot errors, and protect system integrity.

• Provide customer support and respond to requests.

• Communicate account, service, legal, or policy information.

• Maintain records of agreement acceptance where applicable.

• Improve the functionality, reliability, and user experience of the Service.

We do not sell user personal data unless separately and clearly disclosed and legally permitted.

3. AI, OCR, AND AUTOMATED PROCESSING

The Service may use OCR, automated calculations, analytics, and AI-assisted processing to provide requested functionality. Information necessary to perform these functions may be transmitted to third-party processors acting in support of the Service.

OCR-extracted data, automated calculations, analytics, AI-generated outputs, and other Service-generated results are informational only and may contain errors, omissions, or inaccuracies. Users are responsible for reviewing and verifying material information before relying on it.

4. THIRD-PARTY SERVICE PROVIDERS

The Service may rely on third-party providers for infrastructure, authentication, analytics, OCR or document processing, AI or automated processing, diagnostics, subscription management, platform billing, and related functionality.

These providers may process information on our behalf or under their own applicable platform terms as necessary to provide their services. Their handling of information may also be subject to their own privacy practices and legal obligations.

We do not provide full payment-card credentials to Profitility merely because a user purchases a subscription through a supported app-store platform.

5. SUBSCRIPTIONS AND PAYMENT INFORMATION

Paid subscriptions purchased through the Apple App Store or Google Play are processed and billed by the applicable platform provider. The Company does not directly collect or store your full payment-card credentials for those platform transactions.

We may receive or process subscription-related information necessary to determine access, such as product or plan identifiers, entitlement status, billing period, renewal or expiration information, transaction status, or other subscription metadata supplied by the platform or subscription-management provider.

6. DATA STORAGE AND SECURITY

We use reasonable technical, administrative, and organizational safeguards designed to protect information appropriate to the nature of the Service and the information processed.

No system, transmission method, or storage environment is completely secure. We cannot guarantee absolute security. Users should maintain independent copies of records that are important for tax, financial, accounting, or business purposes.

7. DATA RETENTION

User data is retained only as reasonably necessary to provide the Service, comply with applicable legal obligations, protect the security and integrity of the Service, prevent fraud or abuse, resolve disputes, and enforce applicable agreements.

Retention periods may vary based on the type of information, account status, applicable feature, legal obligations, security requirements, backup practices, and deletion requests. We do not promise automatic deletion of inactive accounts on a fixed schedule unless such a process is expressly stated in the current Account Deletion & Data Retention Policy.

8. ACCOUNT DELETION

Users may request deletion of their account at any time through the App or by contacting support at support@profitility.app.

The current Account Deletion & Data Retention Policy governs the production deletion process, including any available deactivation or recovery period, permanent deletion from active systems, immediate permanent-deletion options if offered, limited retention required for legal or security purposes, and backup handling.

Deleting a Profitility account does not itself cancel a subscription billed through Apple or Google. Platform subscriptions must be managed through the applicable platform.

9. DATA OWNERSHIP

Users retain ownership of the data and content they provide. The Company is granted a limited license to store, process, analyze, and display that data as reasonably necessary to operate, maintain, secure, support, and improve the Service.

Use of the Service does not transfer ownership of user data to the Company.

10. AGREEMENT AND ACCEPTANCE RECORDS

Where the Service requires affirmative acceptance of an agreement, policy, or disclosure, the Company may maintain a record of the document or agreement type, version, acceptance date and time, account identifier, and language presented.

Historical acceptance records may be retained as reasonably necessary to document the terms previously accepted and to administer later re-acceptance requirements.

11. CHILDREN’S PRIVACY

The Service is not directed to individuals under eighteen (18) years of age, and we do not knowingly collect personal information from children through an account intended for adult users. If we learn that information was collected from a child in circumstances requiring deletion, we will take appropriate steps consistent with applicable law.

12. INTERNATIONAL USERS

Profitility is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored in, or processed in the United States or other locations where our service providers operate, subject to applicable law.

13. YOUR CHOICES AND RESPONSIBILITIES

• You may update available account or business information through the Service.

• You may request account deletion as described above.

• You may manage app-store subscription settings through the applicable Apple or Google platform.

• You are responsible for verifying financial, tax, OCR-extracted, automated, and AI-generated information before relying on it.

• You may contact support@profitility.app with privacy-related questions or requests.

14. TAX, FINANCIAL, AND AI INFORMATION

The Service provides informational and organizational tools only and does not constitute tax, legal, accounting, financial, investment, or other professional advice. AI-generated insights, summaries, recommendations, forecasts, and similar outputs are provided for informational purposes only.

15. PLATFORM NON-AFFILIATION

Profitility is not affiliated with, endorsed by, or sponsored by any third-party delivery or gig platform.

16. ENFORCEMENT AND TERMINATION

The Company may suspend or terminate access for violation of applicable terms, including fraud, abuse, unlawful activity, or conduct that threatens the security or integrity of the Service. Data handling following termination remains subject to this Policy and applicable retention and deletion requirements.

17. ARBITRATION

Any dispute arising out of or relating to this Policy shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.

18. MODIFICATIONS, VERSIONING, AND ACCEPTANCE

The Company may modify this Policy from time to time. Continued use of the Service after the revised Policy becomes effective constitutes acceptance except where affirmative acceptance is required by law or required by the Service.

Material changes may be communicated by in-app notice, email when available, an updated Effective Date, or a request for affirmative acceptance. Where affirmative acceptance is required, Profitility may use the Version: field to determine whether re-acceptance is required.

19. SEVERABILITY

If any provision of this Policy is found unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

20. RELATIONSHIP TO OTHER POLICIES

This Policy should be read together with the Terms of Service, EULA, Account Deletion & Data Retention Policy, Subscription Terms, and other applicable Profitility agreements and disclosures. A more specific policy may provide additional information about a particular processing activity or program.

21. GOVERNING LAW

This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
