This Tax & Financial Disclaimer (“Disclaimer”) governs your use of the Profitility mobile application and related services (collectively, the “Service”).
By creating an account or using the Service, you acknowledge and agree to this Disclaimer.
1. Purpose of the Service
The Service provides informational and organizational tools only and does not constitute tax, legal, accounting, or financial advice.
2. No Professional Advice
The Service does not provide professional advice of any kind.
You are solely responsible for:
• Filing taxes
• Maintaining accurate records
• Complying with applicable laws
• Making financial decisions
You should consult a qualified professional regarding your specific situation.
3. Data Accuracy
All OCR-extracted data and analytics outputs are informational estimates only and may contain errors.
4. Platform Non-Affiliation
Profitility is not affiliated with, endorsed by, or sponsored by any third-party delivery or gig platform.
5. Tax Responsibility
You are solely responsible for tax filings, compliance, and financial reporting.
6. Third-Party Services
The Service relies on third-party providers for infrastructure, analytics, OCR processing, and payment processing.
We are not responsible for service interruptions, data loss, or performance issues caused by third parties.
7. User Responsibilities
You are responsible for:
• Providing accurate information
• Verifying all outputs
• Maintaining independent records
• Using the Service lawfully
8. Limitation of Liability
To the fullest extent permitted by law, Grindstone Holdings LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wages, or data inaccuracies.
This includes, without limitation:
• Tax penalties or audit outcomes
• OCR errors or data extraction inaccuracies
• Financial or business decisions made using the Service
Total liability shall not exceed:
• The amount paid by the user in the twelve (12) months preceding the claim, or
• Fifty dollars ($50) if no payment has been made
9. Indemnification
Users agree to indemnify and hold harmless Grindstone Holdings LLC from claims arising from:
• Misuse of the Service
• Violation of this Disclaimer
• Fraudulent or unlawful activity
• User-provided data or financial decisions
10. Enforcement / Termination
The Company may suspend or terminate access for violation of these terms, including fraud, abuse, or unlawful activity.
11. Arbitration
Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.
12. Modifications
The Company may modify these terms at any time. Continued use of the Service constitutes acceptance of the revised terms.
Material changes may be communicated through:
• In-app notification
• Email (if available)
• Updated Effective Date
13. Severability
If any provision of this Disclaimer is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
This Disclaimer constitutes the entire agreement regarding tax and financial use of the Service.
15. Governing Law
This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
