The Service provides informational and organizational tools only and does not constitute tax, legal, accounting, financial, investment, or other professional advice.
2. NO PROFESSIONAL RELATIONSHIP
Use of Profitility does not create an accountant-client, attorney-client, tax-adviser, investment-adviser, fiduciary, or other professional advisory relationship with Grindstone Holdings LLC.
3. ESTIMATES AND CALCULATIONS
Tax estimates, profitability calculations, mileage-related calculations, expense categorizations, projections, summaries, and similar outputs may rely on user-entered data, assumptions, formulas, or automated processing and may not reflect every rule or circumstance applicable to you.
4. OCR AND AI OUTPUTS
OCR-extracted data, automated calculations, analytics, AI-generated insights, recommendations, forecasts, summaries, and other generated results are informational only and may contain errors, omissions, or inaccuracies. Users must independently verify material information.
5. USER RESPONSIBILITY
You are solely responsible for maintaining adequate records, determining applicable tax obligations, filing accurate returns, substantiating deductions, complying with laws and platform requirements, and making financial or business decisions.
6. PROFESSIONAL ASSISTANCE
Consult an appropriately qualified tax, legal, accounting, financial, or other professional regarding your specific circumstances when professional advice is needed.
7. NO GUARANTEE OF RESULTS
Profitility does not guarantee tax savings, profitability, earnings, deductions, business performance, audit outcomes, or any particular financial result.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Grindstone Holdings LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost wages, tax penalties, filing errors, audit outcomes, OCR errors, automated calculation errors, AI-output inaccuracies, or financial or business decisions made using the Service. Total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim, or fifty dollars ($50) if no payment has been made.
9. ENFORCEMENT AND TERMINATION
The Company may suspend or terminate access for violation of applicable terms, including fraud, abuse, unlawful activity, or conduct that threatens the security or integrity of the Service.
10. ARBITRATION
Any dispute arising out of or relating to this policy shall be resolved by binding arbitration in Hamilton County, Tennessee, except where prohibited by law. You waive the right to participate in class actions or class-wide proceedings.
11. MODIFICATIONS AND VERSIONING
The Company may modify this policy from time to time. Material changes may be communicated through an updated Effective Date, in-app notice, email when available, or affirmative acceptance where required. Profitility may use the Version: field to administer applicable re-acceptance requirements.
12. GOVERNING LAW
This Agreement is governed by the laws of the State of Tennessee, United States, with venue and jurisdiction in Hamilton County, Tennessee.
